Terms & Conditions

1. SAFETY AND HAZARDS


1.1 Accommodation is accessed through and situated on farmland and there are hazards both natural and man-made, including steep drops, uneven surfaces and trip hazards. You accept that you, and any guests or visitors, enter the property at your own risk.

1.2 You are required to, and must ensure that all guests and any approved day visitors, observe the rules and procedures in relation to the property: specified on the Website, as advised by the hosts and contained in the information folder provided at the property.

1.3 Participation by you and any guests or visitors in activities including walking on the property, outdoor baths, climbing trees and any other activity on the property, is done so at your and their own risk.


1.4 To the extent permitted by law, we do not accept any liability for accident, loss of property or personal injury during your stay.

2. CONDITIONS OF OCCUPANCY AND CONDUCT


2.1 Guests have a licence to occupy the property for the paid holiday period only. You are responsible for ensuring that you and they arrive no earlier than the check-in date, and leave no later than the check-out time, specified on the Website.


2.2 You are required to, and must ensure that all guests and any approved day visitors, observe the rules and procedures in relation to the property: specified on the Website, as advised by the hosts and contained in the information folder provided at the property.


2.3 The property is surrounded by neighbouring privately owned land. Guests and any approved visitors access is restricted only to any land specified as part of the property by the host.   

2.4 You must, and must ensure that all guests and any approved visitors, take all reasonable and proper care of the property and its furniture, fittings and effects and leave them in the same state of repair, condition, cleanliness and tidiness as at the commencement of the rental period. Where the property has not been left in the same state of repair, condition, cleanliness and tidiness as at the commencement of the rental period, you will be required to pay an additional cleaning cost of $100 which may be charged to the credit or debit card used at the time of booking.

2.5 You are required to inform the host of any damage or breakage occurring during the rental period in or around the property promptly so that it can be repaired and replaced for the next booking. You must reimburse the host for the reasonable costs of replacement or repair of any damage caused by you or any guests or visitors and such costs may be charged to the credit or debit card (VISA/Mastercard) used at the time of booking.


2.6 You must ensure that any access information in relation to a property (including any access codes, location of keys, etc) is kept confidential and not disclosed to any person.


2.7 Smoking is not permitted anywhere on the site.

2.8 Fires and any naked flames (including candles and lighters) are strictly prohibited on the site.

2.9 Climbing on the domes, solar arrays or any other structures is strictly prohibited.


2.10 The host may access the property during the rental period to the extent reasonably necessary to undertake repairs or replacement or where the host have reason to believe these Booking Terms are not being complied with.


2.11 The number of guests staying overnight must be the same as the number of guests included in the booking. Any day visitors must be approved by the host prior to your stay. No overnight visitors are permitted.


2.12 You and all guests and any approved day visitors must behave in a proper, appropriate and legal manner with due respect to the host, the property, other guests and neighbouring properties and neighbours.

2.13 Pets are not allowed on the property.

3. ACCESS

3.1 The property is accessed via a shared, single lane, unsurfaced private driveway with a strict 20km per hour limit. The private driveway is shared by neighbouring houses and properties where children and pets reside, as such all care and attention must be taken at all times.

3.2 Guests are encouraged to be picked up from Pukerua Bay Railway (or the Railway carpark) by the host who will by prior agreement take guests up to site. Guests may with prior agreement of the host drive private vehicles to a private carpark where they may park their vehicle for the duration of the stay. 

3.3 Guests are asked to refrain from driving down the shared private driveway after 9pm unless in the case of emergency. 

3.4 From the private carpark the property can then be accessed either via foot over a 4WD track with steep sections or by a host operated 4WD vehicle. Guests are forbidden from taking their own vehicles up the 4WD track. 

3.5 Should guests elect to walk to the property a reasonable level of fitness and physical health is recommended as the 4WD track is steep in some sections

3.6 Similarly on site uneven and steep surfaces exist that mean that those with reduced mobility may need extra support to get to and move around the property.

4. CANCELLATION POLICY


4.1 Guest Cancellation 

4.1.1 Date Change.  Bookings can be changed to another date within 12 months of the original booking, if guests cancel their stay more than 3 Days prior to their check-in time, without any additional cost or forfeit of any amounts paid.


4.1.2 Refunds will be provided to guests that cancel more than 3 Days prior to their check-in time, without any additional cost or forfeit of any amounts paid.  

4.1.3 Cancellation or date changes made 3 Days (72 hours) or less prior to their check-in time will result in 100% of the total cost of their original stay being charged.


4.1.4 Force Majeure

Guests are entitled to a full refund if they need to cancel because of a force majeure event that prevents them from accessing the site including:

-  a natural disaster causing large scale disruption to essential services or transport routes; and

-  a Metservice red weather warning issued for any period of the stay. 

4.2 Host Cancellation

4.2.1 Exceptional or unforeseen circumstance


The host reserves the right to cancel a booking at any time in the event of exceptional or unforeseen circumstances. This right will only be exercised in good faith and in exceptional circumstances such as:


(a) Any alteration to the property or its surroundings which may pose a safety risk for the guest.
(b) Unexpected damage or destruction at the property.


In the unlikely event the host cancels under this clause, the guest may elect to receive a full refund or to credit the booking to another available date. The host’s liability will be limited to the refund of amounts paid for any part of your stay that is cancelled.

4.3 Cancellation for breach


The host may terminate a booking at any time if they, or we, reasonably believe that there is, or has been, a breach of these Booking Conditions by you or any guest or visitor. Where the host cancels under this clause, all amounts paid are forfeited and, where such termination occurs during the rental period, you and all guests and visitors must immediately leave the property.

5. GST 

GST of 15% is included in the daily per night cost. 

6. COMPLAINTS

If you have any complaints, please contact us promptly at help@floruit.nz with details of the complaint and to the extent possible we will seek to resolve the issue as swiftly as possible

7. LIABILITY

7.1 To the maximum extent permitted by law and except as otherwise expressly provided for in these Booking Terms, we have no liability, to you or any other person for acts or omissions under or in relation to these Booking Terms and Conditions or your stay.


7.2 Any liability we have to you under or in relation to these Booking Terms and Conditions or your stay is, to the extent permitted by law, limited to refund of amounts paid by you for the relevant booking and shall not extend to any other costs or loss incurred by you or any guest or other person.

8. LAW

These Booking Terms and Conditions are governed by New Zealand law and the New Zealand courts have exclusive jurisdiction.

9. CHANGES TO BOOKING CONDITIONS

We may amend these Booking Terms and Conditions at any time. Any changes shall apply to bookings made from the date of such changes. You are responsible for familiarising yourself with these Booking Terms and Conditions each time you make a booking.


10. AUTHORITY TO SIGN

As the person who completes the Booking Form, you certify that all information provided is true, accurate and correct and that you: are authorised to agree to the Booking Conditions on behalf of all persons included in the Booking Form, including those substituted or added at a later date; are over eighteen years of age; agree to take responsibility for the party occupying the property and shall ensure that they (and any approved visitors) comply with these Booking Terms and  Conditions; and will notify us if you are not present at the property for the rental period
